Introduction and General Provisions
- These Terms and Conditions of Use (hereinafter the "Terms") set out the procedure for obtaining and using the QR coupons provided to subscribers within the framework of the "Nar x Crunch Burger" campaign (hereinafter — the "Campaign"), carried out through the cooperation between Nar and Crunch Burger, the rules for participating in the Campaign, as well as the rights and obligations of the parties in connection with the Campaign. Within the framework of the Campaign, coupons are provided to Nar subscribers via SMS, and these coupons may be used at Crunch Burger branches to obtain a discount.
- The Campaign is carried out for the period determined by Nar and in accordance with these Terms. Coupons provided within the framework of the Campaign may only be used in the manner and on the conditions set out in these Terms.
- By participating in the Campaign and/or using a provided coupon, the subscriber confirms that they have read these Terms and accept them unconditionally.
- In compliance with the requirements of applicable legislation, Nar reserves the right to amend the rules for conducting the Campaign, the terms of use, the duration of the Campaign, the participation criteria, the benefits offered, and other conditions, or to suspend the Campaign in whole or in part.
- The subscriber's continued use of the Campaign after any changes shall be deemed acceptance of those changes.
- Changes made to the Terms shall take effect from the moment they are posted on Nar's official website, in the Nar+ mobile application, or otherwise brought to the attention of participants through appropriate means of communication.
- The Campaign remains in effect until the coupons are exhausted or until it is suspended by Nar.
Requirements for Participation in the Campaign
- Only subscribers who meet the campaign conditions determined by Nar may participate in the Campaign. In accordance with the conditions set by Nar, operations and actions such as balance top-ups of a specified amount, tariff plan changes, and the like, may serve as grounds for earning a coupon.
- After using a coupon, the subscriber may not request the reversal of the mobile number balance top-up, or of the balance-usage transaction (payment), that served as the basis for obtaining the coupon.
- Nar reserves the right not to provide a coupon to persons who do not meet the Campaign's conditions, or who have obtained a coupon as a result of a technical error, fraud, or other misuse, and reserves the right to deem any coupon already provided invalid.
Conditions Relating to the Use of the Coupon
- The coupon is for one-time use only.
- The coupon may only be used within the validity period indicated in the link within the QR code.
- Coupons are limited in number, and meeting the Campaign's conditions does not guarantee that a coupon will be provided.
- The coupon may only be used where the amount of the order placed by the subscriber exceeds the value of the coupon.
- To use the coupon, the subscriber must present the coupon's QR code at the checkout of the Crunch Burger restaurant when placing an order.
- An expired coupon shall be deemed invalid and will not be renewed, restored, or replaced.
- The coupon may not be exchanged for cash or replaced with another discount or benefit.
- The subscriber may obtain only one coupon per denomination.
Collection and Processing of Personal Data
- For the purposes of providing services within the framework of the Campaign and performing these Terms, Nar may collect and process the subscriber's personal data in accordance with the requirements of the legislation of the Republic of Azerbaijan. By participating in the Campaign, the subscriber confirms their consent to the collection and processing of their personal data.
- For the purposes of organizing, carrying out, and managing the Campaign, the following personal data is processed:
- phone number;
- information relating to the subscriber's account;
- payment and subscription information.
- Personal data may be collected and processed for the following purposes:
- organizing and managing the Campaign;
- providing coupons and verifying their use;
- ensuring security and preventing fraud;
- improving service quality and subscriber experience;
- fulfilling obligations arising from legislation.
- Where necessary for the performance of the Campaign, Nar may provide only the personal data necessary for the relevant purpose to the Campaign's partner organization, in accordance with the legislation of the Republic of Azerbaijan.
- In accordance with applicable legislation, the subscriber has the right to obtain information about their personal data, and to request its correction, updating, and deletion.
Liability of the Parties
- The subscriber is responsible for using the coupon in accordance with these Terms and for the accuracy of the information provided when using the coupon.
- Crunch Burger restaurants are solely responsible for the acceptance of the coupon, the conditions of its application, and the availability, range, quality, safety, price, service level, and reservation options of the products and services offered, as well as for all obligations arising from the acceptance or use of the coupon.
- Nar only ensures that the coupon is provided to the subscriber and bears no responsibility whatsoever — and provides no warranty or guarantee — for the products and services offered by Crunch Burger, their availability, non-provision or improper provision, refusal to accept the coupon, or any related claim, objection, complaint, damage, loss, claim for compensation, or other dispute that may arise in connection therewith.
- Nar shall not be liable for the non-provision, delay, invalidity, or impossibility of use of the coupon due to reasons beyond Nar's control, including technical malfunctions, interruptions in electronic communication networks, actions of third parties, force majeure events, and other similar circumstances.
- Nar shall not be liable for any indirect, incidental, special, or consequential damages related to the coupon, including lost profits, anticipated benefits, or other indirect losses.
Final Provisions
- These Terms shall be interpreted and governed in accordance with the legislation in force in the Republic of Azerbaijan.
- Any dispute or disagreement that may arise between the parties in connection with the application or performance of these Terms shall first be settled through mutual negotiations.
- If a dispute cannot be resolved through negotiations, it shall be resolved by the competent courts in accordance with the legislation of the Republic of Azerbaijan.
